Shane O’Connell Design, LLC DBA Brand Accurate (“Brand Accurate,” “we,” “our,” or “us”) respects your privacy and is committed to protecting personal information entrusted to us.

This Privacy Policy describes how we collect, use, disclose, store, and protect information when you:

  • Visit brandaccurate.com or other websites operated by Brand Accurate;
  • Use the Brand Accurate software platform, including app.brandaccurate.com;
  • Create or use a Brand Accurate account;
  • Participate in an organization’s Brand Accurate employee advocacy program;
  • Connect a third-party account or service, including LinkedIn, to Brand Accurate;
  • Communicate with Brand Accurate; or
  • Otherwise use our products and services.

By using Brand Accurate, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

The information we collect depends on how you interact with Brand Accurate and which features you or your organization choose to use.

A. Account and Profile Information

When you create or use a Brand Accurate account, we may collect information such as:

  • Name;
  • Email address;
  • Company or organization;
  • Job title;
  • Department;
  • Profile photograph;
  • Account role or permission level;
  • Account and authentication information;
  • Organization membership information; and
  • Other information you choose to provide through your Brand Accurate profile.

B. Organization Information

Organizations using Brand Accurate may provide information necessary to establish and administer their workspace, including:

  • Organization name;
  • Organization website and domain;
  • Organization logo and branding;
  • Departments;
  • Employee membership information;
  • Workspace settings;
  • Authorized administrators;
  • Connected social accounts or company pages; and
  • Program settings and communications.

C. Employee Advocacy and Activity Information

When you participate in an employee advocacy program through Brand Accurate, we may process information relating to your participation, such as:

  • Eligible advocacy activities;
  • Points earned;
  • Awards and recognition;
  • Leaderboard position;
  • Department-level participation;
  • Engagement history;
  • Program activity history; and
  • Other information necessary to provide employee advocacy features.

Brand Accurate is intended to recognize eligible employee advocacy activity. Brand Accurate does not require employees to engage with any particular social media content, and employees decide whether and how they choose to participate.

D. LinkedIn Information

Brand Accurate allows organizations and participating users to connect certain LinkedIn accounts and services.

When an authorized organization administrator connects a LinkedIn Company Page or when a participating employee voluntarily connects their LinkedIn identity, Brand Accurate may receive and process information made available through LinkedIn’s approved APIs and authorized by the applicable user or organization.

Depending on the LinkedIn APIs, permissions, and features authorized, this information may include:

  • LinkedIn member identifiers;
  • Name and profile information;
  • Profile photograph;
  • LinkedIn Company Page identifiers and information;
  • Company Page posts and other authorized content;
  • Comments;
  • Reactions;
  • Shares or reposts;
  • Engagement information associated with company content;
  • Information identifying an eligible actor associated with an engagement, where provided by LinkedIn;
  • LinkedIn authorization, connection, and token information necessary to maintain the integration; and
  • Other information made available through LinkedIn APIs that is necessary to provide the authorized Brand Accurate functionality.

The specific LinkedIn information available to Brand Accurate depends on LinkedIn’s APIs, permissions, user choices, organization permissions, and LinkedIn’s own policies and settings.

2. How We Use Information

We use personal information for legitimate business purposes related to providing, securing, supporting, and improving Brand Accurate.

These purposes may include:

  • Creating and maintaining Brand Accurate accounts;
  • Authenticating users;
  • Managing organization workspaces and memberships;
  • Providing employee advocacy functionality;
  • Displaying authorized company content;
  • Identifying eligible participation in an organization’s employee advocacy program;
  • Associating eligible engagement with participating employees when permitted by applicable integrations;
  • Calculating and awarding advocacy points;
  • Generating leaderboards;
  • Providing department-level participation and rankings;
  • Providing awards and employee recognition;
  • Displaying an employee’s own activity history;
  • Providing administrators with information necessary to manage their organization’s advocacy program;
  • Operating third-party integrations authorized by users or organizations;
  • Maintaining and troubleshooting integrations;
  • Providing customer service;
  • Sending service-related communications;
  • Improving the functionality, reliability, usability, and security of Brand Accurate;
  • Detecting fraud, abuse, unauthorized access, or other security issues;
  • Enforcing our agreements and policies; and
  • Complying with applicable laws and legal obligations.

3. How We Use LinkedIn Data

Information obtained through LinkedIn APIs is used to provide the LinkedIn-related employee advocacy functionality authorized by the applicable organization or participating user.

For example, LinkedIn information may be used to:

  • Connect an authorized LinkedIn Company Page to an organization’s Brand Accurate workspace;
  • Retrieve and display authorized company content;
  • Help participating employees discover company content;
  • Identify eligible reactions, comments, shares, reposts, or other supported engagement with company content;
  • Associate eligible activity with a participating employee when that information is provided through LinkedIn’s approved APIs;
  • Recognize employee advocacy participation through points, leaderboards, activity history, awards, and related features;
  • Provide organization administrators with appropriate advocacy program information; and
  • Maintain and support the LinkedIn integration.

Brand Accurate does not automatically like, comment on, share, repost, or otherwise create LinkedIn engagement on behalf of participating employees unless a separate feature is expressly authorized by the user and permitted by LinkedIn.

Employees retain control over whether and how they engage with content on LinkedIn.

4. LinkedIn Data and Advertising or Sales

Brand Accurate does not use personal data obtained through LinkedIn’s Community Management APIs for:

  • Advertising or ad targeting;
  • Building advertising audiences;
  • Sales prospecting;
  • Selling leads;
  • Selling LinkedIn-derived personal information; or
  • Providing LinkedIn-derived personal or activity information to advertisers for targeting individuals.

If Brand Accurate offers rewards, sponsorships, promotions, or other commercial programs now or in the future, personal data obtained through LinkedIn’s Community Management APIs will not be used for advertising or sales purposes in violation of LinkedIn’s applicable terms, policies, or developer requirements.

5. Separation of Customer Data

Brand Accurate operates separate organization workspaces.

Personal data or activity data obtained through LinkedIn’s Community Management APIs for the purpose of providing services to a particular customer or managing that customer’s connected LinkedIn Page is not shared with other Brand Accurate customers.

For example, one Brand Accurate customer does not receive access to another customer’s:

  • Employee LinkedIn profile information;
  • Individual employee engagement information;
  • LinkedIn-derived activity records;
  • Comments or reactions associated with individual employees; or
  • Other LinkedIn-derived personal information.

Brand Accurate may process aggregated or de-identified service information where permitted by applicable law, contractual obligations, and applicable third-party platform requirements. We do not use aggregation or de-identification to circumvent restrictions applicable to LinkedIn data.

6. Information Provided by Your Organization

If you use Brand Accurate through your employer or another organization, that organization may provide information about you or administer aspects of your Brand Accurate workspace.

Organization administrators may have access to information associated with participation in their organization’s Brand Accurate program, such as:

  • Your name and business profile information;
  • Department;
  • Program role;
  • LinkedIn connection status;
  • Eligible advocacy activity;
  • Points;
  • Rankings;
  • Awards; and
  • Other organization-specific program information.

The organization is responsible for its own notices, policies, employment practices, and lawful use of information available to it through Brand Accurate.

7. Website, Device, and Usage Information

When you access our website or application, we may automatically collect technical information such as:

  • IP address;
  • Browser type;
  • Device type;
  • Operating system;
  • Pages or features accessed;
  • Date and time of access;
  • Referring website;
  • Application events;
  • Error and diagnostic information; and
  • Other technical information used to operate and secure our services.

We may use cookies and similar technologies to maintain sessions, remember preferences, understand service usage, improve functionality, and protect Brand Accurate.

You may be able to control certain cookies through your browser settings. Disabling cookies may affect the functionality of certain Brand Accurate features.

8. How We Share Information

Brand Accurate does not sell or rent personal information.

We may disclose information in the following circumstances:

Service Providers

We may use vendors and service providers to help us host, secure, maintain, analyze, communicate through, or otherwise operate Brand Accurate.

These providers may process information only as necessary to provide services to Brand Accurate and subject to applicable contractual, confidentiality, privacy, and security requirements.

Your Organization

If your account belongs to an organization workspace, appropriate information may be available to authorized administrators of that organization as necessary to operate its Brand Accurate program.

Legal and Safety Requirements

We may disclose information when we reasonably believe disclosure is necessary to:

  • Comply with applicable law, regulation, subpoena, court order, or other legal process;
  • Protect the rights, property, or safety of Brand Accurate, our users, or others;
  • Investigate fraud, security incidents, or misuse of our services; or
  • Establish, exercise, or defend legal claims.

Business Transfers

Information may be transferred in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction, subject to applicable legal and contractual requirements.

9. Third-Party Services and Integrations

Brand Accurate may integrate with third-party platforms and services.

When you or your organization chooses to connect a third-party service, information may be exchanged between Brand Accurate and that service as necessary to provide the requested integration.

Third-party platforms operate under their own terms and privacy policies. Your use of LinkedIn, for example, remains subject to LinkedIn’s own agreements, settings, and privacy practices.

Brand Accurate’s access to and use of information received from third-party APIs is also subject to applicable agreements and developer requirements imposed by those providers.

10. LinkedIn Authorization and Consent

Connecting LinkedIn to Brand Accurate is voluntary.

Before initiating an applicable LinkedIn authorization process, users are provided information about the purpose of the connection and can choose whether to proceed.

LinkedIn may also present its own authorization or consent interface describing permissions requested by Brand Accurate.

A user may withdraw Brand Accurate’s access by disconnecting the applicable integration where that functionality is available, revoking authorization through LinkedIn where supported, or contacting Brand Accurate at contact@brandaccurate.com.

Withdrawal of authorization may prevent certain Brand Accurate features from functioning.

11. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

  • Provide our services;
  • Maintain an active account or organization workspace;
  • Fulfill contractual obligations;
  • Maintain security and prevent fraud;
  • Resolve disputes;
  • Enforce agreements; and
  • Comply with legal requirements.

Information obtained through LinkedIn APIs is retained only as permitted by applicable LinkedIn terms, developer documentation, and requirements.

When information is no longer required or permitted to be retained, we may delete, anonymize, or otherwise securely dispose of it.

12. Disconnecting LinkedIn and Deleting LinkedIn Data

Users may withdraw authorization for a LinkedIn connection by using available Brand Accurate account or integration controls, revoking authorization through LinkedIn where supported, or contacting us at contact@brandaccurate.com.

Users may also request deletion of personal information associated with their Brand Accurate account, including applicable personal information obtained through LinkedIn APIs.

To submit a deletion request, email:

Please include sufficient information for us to identify your Brand Accurate account and process the request.

Upon a valid deletion request, Brand Accurate will delete applicable personal information as required by law and applicable LinkedIn requirements, except where retention is legally required or otherwise permitted.

Disconnecting LinkedIn may stop future collection of information through the applicable connection but may not automatically delete all previously collected information. A user seeking deletion of previously collected information should submit a deletion request.

13. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure.

These measures may include, as appropriate:

  • Authentication and authorization controls;
  • Role-based access;
  • Organization-level data separation;
  • Encryption or other protection for sensitive credentials;
  • Access restrictions;
  • Logging and monitoring;
  • Secure hosting infrastructure; and
  • Procedures intended to protect third-party access credentials and integration tokens.

No internet transmission or electronic storage system can be guaranteed to be completely secure, and we cannot guarantee absolute security.

14. Access Credentials and Integration Tokens

Third-party authorization credentials, including access tokens used to operate integrations, are treated as sensitive information.

Brand Accurate uses such credentials only as necessary to provide authorized integration functionality and does not intentionally expose those credentials to other customers or unauthorized users.

15. Your Privacy Rights and Choices

Depending on where you live, you may have rights concerning your personal information, which may include the right to:

  • Request access to personal information we maintain about you;
  • Request correction of inaccurate information;
  • Request deletion of personal information;
  • Request restriction of certain processing;
  • Object to certain processing;
  • Withdraw consent where processing is based on consent; and
  • Exercise other rights provided by applicable law.

You may also unsubscribe from promotional email communications using the unsubscribe mechanism included in those communications.

Service-related communications necessary to operate your Brand Accurate account may continue while your account remains active.

We may need to verify your identity before completing certain requests.

16. Data Relating to Employees

Brand Accurate is designed primarily for business and professional use.

Participation in a Brand Accurate employee advocacy program does not require an employee to engage with any specific social media post or perform any particular social media activity unless separately required by the employee’s organization under its own policies.

Brand Accurate provides technology for organizations to operate employee advocacy programs. Each organization is independently responsible for its employment practices, internal policies, and decisions concerning its employees.

17. Children’s Privacy

Brand Accurate is a business and professional service and is not directed to children under the age of 13.

We do not knowingly collect personal information from children under 13. If we become aware that such information has been collected inappropriately, we will take reasonable steps to delete it.

18. International Users

Brand Accurate may process and store information in the United States or other jurisdictions in which Brand Accurate or its service providers operate.

If information is transferred across jurisdictions, we take reasonable measures intended to handle the information in accordance with applicable privacy and data protection requirements.

19. Do Not Sell Personal Information

Brand Accurate does not sell personal information.

Brand Accurate also does not sell personal information obtained through LinkedIn APIs.

If applicable privacy laws provide additional rights concerning the sale or sharing of personal information, requests may be submitted to contact@brandaccurate.com.

20. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our services, integrations, legal obligations, or privacy practices.

When we make changes, we will update the “Last Updated” date at the top of this policy. If required by applicable law, we will provide additional notice or obtain consent for material changes.
